Kim Kardashian filed for divorce after only 72 days of marriage.  The fate of the 20.5 karat diamond ring may be the subject of the couples’ prenuptial agreement.  It is rumored that Kim loved the ring so much that she included a clause in her prenuptial agreement which allows her to keep the ring if the couple divorces, provided she buys the ring for its original purchase price from Kris Humphries who purchased the ring.

A “premarital” (or “prenuptial”) agreement is a contract entered into between a couple in contemplation of marriage which allows them to agree upon certain property rights and financial responsibilities upon marriage or registration as domestic partners.  Provided there is no deception, duress, undue influence or violation of public policy, such agreements are looked upon favorably by the courts as they help to avoid lengthy and expensive litigation over property rights.

In particular, a premarital agreement may validly provide that one spouse’s earnings, such as wages and other income, acquired during marriage will remain separate property, free of any claims from the other spouse.  Such an agreement can also preserve a spouse’s estate in the event of death, for their children, free of the other spouse’s inheritance claims.  A premarital agreement can even determine the fate of a beloved pet in the event the couple divorces.
